Summary

Brandi Levy, a Mahanoy Area High School student in Pennsylvania, was suspended from the junior-varsity cheerleading squad after posting a profane Snapchat on a weekend off campus expressing frustration about not making varsity. The Supreme Court ruled 8–1 in 2021 that the school violated her First Amendment rights.

Full report

In 2017, then-14-year-old Brandi Levy posted a Snapchat from a convenience store on a Saturday reading 'fuck school fuck softball fuck cheer fuck everything,' visible to roughly 250 followers. After a screenshot reached coaches, Mahanoy Area School District removed her from the JV cheer team for a year. The ACLU represented her, and in Mahanoy Area School District v. B.L., 594 U.S. 180 (2021), the Supreme Court held 8–1 that schools' authority to regulate off-campus student speech is sharply limited and that the discipline violated the First Amendment.
